Privacy Policy
1. Introduction
MasOS (the "Service") is a mas band management and operations platform operated by Caribbean Inc., based in New Castle, Delaware, USA. We are committed to protecting your privacy and ensuring the security of your personal information. This Privacy Policy explains what data we collect, how we use it, and the rights you have regarding your information. Effective Date: Sep 16, 2021.
This policy applies to all users of MasOS, including mas band organizers (MasOS clients) and their end-customers (masqueraders) who interact with the Service. By using MasOS, you agree to the collection and use of information in accordance with this Privacy Policy.
2. Information We Collect
We collect personal information that you voluntarily provide to us when using MasOS or contacting us. This includes information from band organizers and masqueraders. The types of personal data we may collect include:
- Contact Information: First name, last name, email address, and phone number.
- Band Details (for Organizers): Band name and band size (number of members or participants) and any other information you choose to share about your band.
- Messages and Inquiries: Information you provide when filling out our contact form or communicating with us (for example, additional details or questions you submit).
- Order and Registration Information: If you are a masquerader or end-customer using the platform (e.g., to register for an event or purchase items), we may collect information related to your order or registration, such as your name, contact details, and any preferences or details needed to fulfill your request.
- Usage Data: When you visit our website or use the Service, we automatically collect certain information via cookies and similar technologies (see Cookies and Analytics below). This may include your IP address, browser type, device identifiers, and browsing actions on our site.
We do not collect sensitive personal information unless necessary and with your consent. We also do not knowingly collect any financial payment information directly – any payments are handled by third-party processors (as described in the Third-Party Services section).
3. How We Use Your Information
We use the personal information we collect solely for legitimate business purposes and to provide and improve our services. Specifically, we may use your information to:
- Provide Services and Process Orders: We use your information to operate the MasOS platform, register your account, and facilitate orders or registrations (for example, allowing masqueraders to sign up for a band or purchase items). This includes processing transactions and ensuring you receive the services or products you requested.
- Communicate with You: We use contact details (such as email and phone) to respond to inquiries, send confirmations, and provide customer support. For band organizers, we may reach out regarding platform updates, demos, or account matters. With your consent, we may also send newsletters or marketing communications about MasOS features and tips for band management.
- Use of Third-Party Tools: We may utilize trusted third-party tools to assist in communications and operations. For example, we use HubSpot to manage contact form submissions and customer relationships, and Mailchimp to send out email updates or newsletters. These tools will use your information only to the extent necessary for those purposes (see Third-Party Services below for more details).
- Improve and Personalize the Service: Information (including usage data) helps us understand how our Service is used. We may analyze usage patterns to improve user experience, add new features, and optimize our website and platform performance.
- Legal and Compliance: We may use or disclose your information as necessary to comply with applicable laws, regulations, and legal processes. This includes using data to prevent fraud, enforce our Terms of Service, or protect the rights and safety of our users, customers, or others.
We will not use your personal information for any purposes other than those described above without obtaining your consent, and we do not sell or rent your personal data to third parties.
4. Third-Party Services
MasOS integrates with several third-party services to operate effectively. These third parties may collect or process your information as part of providing their services. We only share the minimum information necessary, and these providers are obligated to protect your data. The third-party services we use (and examples of how they are used) include:
- Google Analytics: We use Google Analytics to track and analyze website traffic and user behavior on our site. Google Analytics uses cookies to collect data such as your IP address and browsing actions. This helps us understand user engagement and improve our website. (Please refer to the Google Privacy Policy for details on how Google handles this data.)
- HubSpot: We use HubSpot as a customer relationship management (CRM) and marketing tool. When you fill out our contact form or request a demo, the information (like your name, email, band details, etc.) is stored in HubSpot so we can follow up and manage our communications with you. (See the HubSpot Privacy Policy for more information on HubSpot’s data practices.)
- Mailchimp: We use Mailchimp (an email marketing service) to manage our mailing list and send out newsletters or updates to those who have opted in. If you subscribe to receive content for band owners or other updates, your name and email address will be stored in Mailchimp for this purpose. (See Mailchimp’s privacy terms in Intuit’s Global Privacy Statement to understand how Mailchimp protects your data.)
- Payment Processors: If you make payments through MasOS (for example, purchasing costumes or paying registration fees), those payments are processed by independent third-party payment gateways such as Stripe or PayPal. We do not collect or store your credit card numbers or bank account details on our servers. Those details are handled securely by the payment processor. We receive only transaction confirmations or basic details needed to record the transaction (such as amount and status). (For more information, you can review the Stripe Privacy Policy or PayPal Privacy Statement, depending on which payment provider is used.)
Please note that each of these third-party services has its own privacy policy. We encourage you to review their privacy policies to understand how they handle your personal information. MasOS does not control the data practices of these third parties beyond our use of their services.
5. Data Storage and Security
We take the security of your personal information seriously. Data collected through MasOS is stored on secure servers provided by Amazon Web Services (AWS), a reputable cloud hosting provider. We implement a variety of security measures to safeguard your data, including:
- Encryption: Sensitive data is transmitted over HTTPS (Secure Socket Layer/SSL) encryption to prevent eavesdropping. We also employ encryption at rest for stored data where appropriate.
- Access Controls: Personal information is accessible only to authorized personnel who need it to perform their duties (for example, providing support or maintaining the system). We restrict access via user authentication and regularly review permissions.
- Firewalls and Monitoring: Our servers are protected by network firewalls and monitoring systems to detect and block unauthorized access attempts. We keep our software and infrastructure updated with security patches.
- Security Policies: Caribbean Inc. maintains internal policies and training for staff to ensure your data is handled properly and confidentially. We also contractually require any service providers handling personal data to uphold strong security standards.
While we strive to use commercially acceptable means to protect your personal information, please note that no method of transmission over the internet or electronic storage is 100% secure. Therefore, we cannot guarantee absolute security. In the unlikely event of a data breach that affects your personal information, we will notify you as required by law and take immediate steps to mitigate the issue.
6. User Rights
You have important rights regarding the personal information we hold about you. We respect your rights and provide ways for you to exercise them. These rights include:
- Access and Portability: You may request a copy of the personal data we have about you. We will provide this information, in a common electronic format, subject to applicable law and verification of your identity.
- Correction: If any of your information is inaccurate or outdated, you have the right to ask us to correct or update it. We encourage you to keep your data up-to-date and will promptly make corrections upon request.
- Deletion: You can request that we delete your personal information. If you no longer use MasOS or if you simply wish to have your data removed, please contact us. We will delete the information we hold about you unless we are required to retain it for legal reasons (such as record-keeping or to complete transactions you initiated).
- Withdrawal of Consent: If you have given consent for us to use your information (for example, for receiving marketing emails), you have the right to withdraw that consent at any time. You can unsubscribe from marketing communications by using the unsubscribe link in our emails or by contacting us directly. Once you withdraw consent, we will stop using your information for that purpose.
- Objection or Restriction (if applicable): In certain circumstances, you may have the right to object to or request the restriction of processing of your personal data. For example, if you believe our processing is not justified, you can ask us to restrict use until we resolve your concern.
To exercise any of these rights, please contact us using the information in the Contact Information section below. We will respond to your request as soon as possible, generally within 30 days. Please note that for security, we may need to verify your identity before fulfilling certain requests. We will not discriminate against you for exercising your privacy rights.
7. Cookies and Analytics
Like most online services, MasOS uses cookies and similar tracking technologies to ensure our website functions properly and to enhance your user experience. Cookies are small text files that are placed on your device (computer or mobile) when you visit a website. We use the following types of cookies and tracking tools:
- Essential Cookies: These are necessary for the website to operate. For example, they may enable basic functions like page navigation and access to secure areas. The site cannot function properly without these cookies.
- Analytics Cookies: We use analytics tools (such as Google Analytics as mentioned above) that set cookies to collect information about how visitors use our site. This includes data like which pages are visited, how long users stay, and which links are clicked. This information is aggregated and does not directly identify individuals. It helps us improve the content and usability of our website. Google Analytics may use its own cookies; you can learn how Google Analytics works and opt out of Google Analytics tracking by visiting the Google Analytics opt-out page.
- Functional Cookies: In some cases, we might use cookies to remember your preferences and settings to provide enhanced features (for instance, remembering a returning user’s details to simplify login or form filling). Currently, MasOS primarily uses cookies for analytics and essential technical purposes rather than personalization, but this may evolve as our services grow.
By using our website, you consent to the use of cookies as described in this policy. You have choices regarding cookies:
- Browser Controls: You can set your web browser to refuse some or all cookies, or to alert you when cookies are being sent. Each browser is different, so check your browser’s help menu for instructions on how to change or update your cookie settings.
- Opt-Out: For analytics cookies like those from Google Analytics, you can use Google’s opt-out tool linked above. Keep in mind that if you disable cookies, certain features of the Service may not function as intended.
We may also use other tracking technologies (like web beacons or pixel tags in emails) to see if you open or act on our communications. This helps us gauge the effectiveness of our communications and improve them. Any such tracking is only used for our internal analytics and to better serve you; we do not use it to profile you for advertising or share this information for others’ advertising purposes.
8. Children’s Privacy
MasOS is not intended for children under the age of 13. We do not knowingly collect personal information from anyone under 13 years old in accordance with the U.S. Children’s Online Privacy Protection Act (COPPA). Our website and services are designed for use by adult business operators and customers.
If you are under 13, please do not use MasOS or provide any information about yourself to us. This includes not providing your name, address, telephone number, email, or any other information. If we learn that we have inadvertently collected personal information from a child under 13, we will delete that information as soon as possible.
Parents or guardians who believe that we might have information about a child under 13 should contact us immediately (see Contact Information below). We will promptly investigate and remove any such data in compliance with applicable laws.
9. Legal Compliance
We operate our Service in the United States and comply with all relevant U.S. privacy laws and regulations. This includes, but is not limited to:
- COPPA: As noted in Children’s Privacy, we adhere to the Children’s Online Privacy Protection Act by not knowingly collecting data from children under 13.
- State Privacy Laws: We respect consumer privacy rights as required by state laws such as the California Consumer Privacy Act (CCPA), to the extent those laws apply to our operations. For example, we do not sell personal information, and California residents have the right to request access to or deletion of their information as described in the User Rights section. If you are a California resident or a resident of a state with similar privacy laws, you can exercise your rights by contacting us.
- Other Laws: We follow other applicable laws regarding data protection and privacy. Caribbean Inc. strives to keep informed of legal changes to ensure ongoing compliance. If we expand our services internationally, we will also comply with relevant international data protection regulations as required.
Additionally, we may disclose personal information if required to do so by law or in response to valid requests by public authorities (e.g., a court order, subpoena, or government inquiry). We may also disclose information if we believe in good faith that it is necessary to investigate or prevent fraud, protect our users’ safety, or enforce our Terms of Service or other agreements.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will notify users in an appropriate manner:
- Posting on Website: We will post the updated Privacy Policy on our website (at the "Privacy Policy" link). The "Effective Date" at the top will be updated to the date of the latest revision so you can easily see if it has changed since your last visit.
- Direct Notification: If the changes are significant or required by law, we will also provide a more prominent notice. This may include sending an email notification to the address we have on file for you or providing an in-app alert, informing you of the updated policy.
We encourage you to review this Privacy Policy periodically for any updates. Your continued use of MasOS after any changes to this policy constitutes your acknowledgment of the changes and your agreement to abide by the updated policy.
